Terms and Conditions of Business.

1 This site is operated by Selbyart

2 By purchasing something from the e-commerce store you agree to be bound by these terms and conditions.

3 Incorporated into these terms are the terms and conditions of our refund policy.

4 We will take all reasonable care to ensure that the details for items offered for sale are correct at the time when the information was loaded on the system.

5 Whilst care is taken to ensure that we display products as accurately as possible, please note that colours, textures and finishes may differ according to computer monitors / equipment, so we cannot guarantee that images are an exact representation of the product you are purchasing.

6 We may not be able to accept your order due to various reasons, which include-

  • If the item you have purchased is out of stock

  • Your payment is not authorised or is in someway suspect

  • There has been a pricing or product description error

  • There is a system or procurement failure

7 When you place an order, you will receive an e-mail confirming the details of the order. The e-mail is not confirmation that your order has been accepted by us.

8 Your order is deemed accepted when the goods are despatched.

9 On completing your purchase an estimated timescale for delivery will be provided. This is an estimate only and your items may be delayed in being received due to circumstances beyond our control ( e.g. courier delay or busy times).

10 If you have to cancel and order you have placed you must contact us immediately to ascertain if the item has been dispatched or not. Where the item has been dispatched you will need to return the item to us and you will be responsible for paying for the cost of returning the items.

11 We endeavour to clearly depict the art work on the site, with accurate sizes, information of the frame etc .We are happy to provide further photos if required to assist in decision making. We therefore do not accept returns.

12 items will be packed carefully to avoid damage in transit and the parcels will be signed for and insured. Any damage in transit will need to be clearly demonstrated to us to allow a claim against the courier. We will work with you to attempt to remedy the problem and it may be possible to repair any damage done so that you get the art work you wanted.

13 You agree to indemnify us and our agents against any claims, liability damages, costs and expenses, including legal fees, arising from any breach of any of our terms and conditions

14 These terms and conditions shall be governed in accordance with the laws of England and are subject to the exclusive jurisdiction of the courts of England and Wales.

15 These terms and conditions constitute the entire agreement between the parties and supersede any and allpreceding and contemporaneous agreements between you and Selbyart, whether written or oral.

16 We may change these terms and conditions at any time

17 Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect.

18 Should any delay, or failure to comply with our obligations under these terms and conditions arise, where it is beyond our reasonable control, we will not be responsible to you for such delay or failure.
